Content Integrity, Defamation & Infringement Policy

Tamer Designs (dba TopSyde). This policy explains how we review the content we publish ourselves, and how we respond to complaints about content published by our hosting clients.

1. Scope of Control

TopSyde provides managed hosting and development services. Under our Master Service Agreement, we exercise no editorial control over content published by clients on their websites, and all such content remains the sole property and responsibility of the client. Clients retain administrative access to their own content. Our policies below address (a) content we publish ourselves and (b) our response to complaints regarding client-hosted content.

2. Content We Publish

All marketing, website, and social media content produced by TopSyde is reviewed prior to publication by the owner or a designated senior team member. Review confirms that claims are factually accurate and substantiable, that no third-party trademarks, copyrighted material, images, or fonts are used without a valid license, and that no statements disparage identifiable persons or entities. Licenses and asset provenance are documented and retained.

3. Client Agreements

Client contracts require clients to warrant that they hold all necessary rights to material they publish, prohibit unlawful, infringing, or defamatory content, and indemnify TopSyde against claims arising from their content. Clients are responsible for their own regulatory and content compliance.

4. Complaint Intake

Complaints regarding infringing or defamatory content may be submitted to hello@topsyde.com or through the TopSyde Client Portal. All complaints are logged with date, complainant, URL, and nature of the claim, and are acknowledged within one business day.

5. Review and Response

Upon receipt, we identify the hosting client responsible for the content and notify them promptly. Complaints alleging copyright infringement are handled under the DMCA notice-and-takedown process; TopSyde maintains a registered DMCA designated agent and will remove or disable access to allegedly infringing material expeditiously upon receipt of a compliant notice, forward the notice to the client, and restore material upon receipt of a valid counter-notice as permitted by law.

6. Defamation and Other Claims

Complaints alleging defamatory content are referred to the client for review and remediation, as the client is the publisher of record. Where content is unlawful on its face, where a court order requires removal, or where the material presents an imminent legal or security risk, TopSyde may remove or disable access to it and, where warranted, suspend the account, in accordance with our service agreements.

7. Records and Escalation

All complaints, notices, actions taken, and dates are retained for a minimum of three years. Matters involving litigation risk, court orders, or law enforcement are escalated to outside counsel before action is taken.

8. Review

This policy is reviewed annually and updated as legal requirements change.
